The data processing takes place because of the instruction and pursuant to Art. 6 para. 1 sentence 1 lit. b General Data Protection Regulation (“GDPR”) it is necessary for the purposes named in relation to the adequate processing of the instruction and the mutual fulfilment of obligations from the Terms and Conditions of Engagement.
The personal data we collect for the instruction will be stored until the expiry of the statutory storage obligation for lawyers’ data (6 years from the end of the calender year in which the instruction was terminated) and will be deleted after that. This does of course not apply if we are authorised and/or obliged to a longer storing with regard to the specific client relationship - e.g. due to provisions with regard to tax law or trade law (cf. Art. 6 para. 1 sentence 1 lit. c GDPR), for the defence against possible liability claims against us or due to an agreement concluded with you (Art. 6 para. 1 sentence 1 lit. a GDPR).
4. Disclosure of Data to Third Parties
A transmission of your personal data to third parties will only take place if this is necessary for the implementation and handling of the client relationship pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR. This includes in particular the disclosure to opponents and their representatives (especially their lawyers) as well as to courts, other public bodies and your liability and/or legal protection insurer for the purpose of correspondence as well as for the assertion and defence of your rights. The third party may not use the disclosed data for any other purposes.
The attorney-client privilege remains unaffected. As far as data are concerned that are subject to the attorney-client privilege, a disclosure to third parties is effected only as agreed upon with you.

3. Basis, Purpose and Duration of the Processing
The data processing takes place because of the lawyer’s contract with our client and pursuant to Art. 6 para. 1 sentence 1 lit. c and lit. f General Data Protection Regulation (“GDPR”) it is necessary for compliance with our legal obligations as lawyers as well as for the purposes of the legitimate interests pursued by our client. With regard to our legitimate interest in the data processing, no prevailing interests or fundamental rights and freedoms of you as data subject are opposed, for we have been instructed by our client, you are involved in the insurance contract as policyholder or insured person and the data processing is necessary for the examination and exercising of our client's rights as well the support for our client in processing the claim.
We only process special categories of data about you as policyholder or insured person insofar as this is necessary for the establishment, exercise or defence of our client's legal claims (Art. 9 para. 2 lit. f GDPR).

- With respect to business/contracting partners, the data processing takes place because of our business relations and insofar is necessary pursuant to Art. 6 para. 1 sentence 1 lit. b General Data Protection Regulation ("GDPR") in order to implement the contract (comprising its initiation and handling) as well as in order to perform the resulting mutual obligations required;
- With respect to other communication partners, the data processing takes place because of the lawyer's contract with our client and is necessary pursuant to Art. 6 para. 1 sentence 1 lit. c and lit. f GDPR for compliance with our legal obligations as lawyers as well as for the purposes of the legitimate interests pursued by our client. As regards our legitimate interest in the data processing, no prevailing interests, fundamental rights and freedoms of you as data subject are opposed, as the data processing is indispensable in order to perform our obligations as lawyers.
Generally, personal data collected by us during the exercise of our professional activities are will be stored for six years from the termination of the business contact or the termination of the contract and will be deleted after that.

2. Collection and Storage of Personal Data
We will collect the following data/information in connection with a BLD-event:
- title (optional);
- salutation, first name, surname;
- company, department, position;
- a valid e-mail-address;
- phone number.
The collection of these data takes place
- exclusively for the proper preparation, execution and follow-up of the BLD-event, namely
- to be able to identify you as our participant;
- to be able to correspond with you;
- to draw up a list of participants on which you can register;
- to display name tags;
- to issue a certificate of participation;
- to be able to invite you to future BLD-events.
3. Basis, Purpose and Duration of the Processing
The data processing takes place on the basis of our agreement on the participation in a BLD-event as well as our interest to invite you to future BLD-events. Pursuant to Art. 6 para. 1 sentence 1 lit. b and lit. f General Data Protection Regulation (“GDPR”), the data processing is necessary in order to implement the (gratuitous) contract (comprising its initiation and handling) as well as in order to perform the resulting mutual obligations and for the purposes of our legitimate interests. As regards our legitimate interest in the data processing for future BLD-events, no prevailing interests, fundamental rights and freedoms of you as data subject are opposed, as the data processing is indispensable for contacting you again.
Generally, personal data collected by us in the context of the BLD-event will be stored for six years from the termination of the event and will be deleted after that. This does of course not apply if, as an exception, we are authorised and/or obliged to a longer storing - e.g. due to provisions with regard to tax law or trade law (cf. Art. 6 para. 1 sentence 1 lit. c GDPR), for the defence against possible liability claims against us or due to an agreement concluded with you (Art. 6 para. 1 sentence 1 lit. a GDPR).
4. Disclosure of Data to Third Parties
A transmission of your personal data to third parties will only take place if this is necessary for the implementation and handling of the event or for performing a legal obligation pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR. In exceptional cases a transfer of your personal data to third parties may become necessary due to our legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, if and insofar as this is not opposed to your interests, fundamental rights and freedoms.

You have the right:
- pursuant to Art. 15 GDPR, to obtain access to your personal data processed by us and certain further information;

2.1 Usage Data
In preparation of a meetBLD web conference, we collect the following data:
- title (optional);
- salutation, first name, surname;
- company, department, position;
- a valid e-mail-address;
- telephone number.
The collection of these data is effected
- for the proper preparation, holding and follow-up of the meetBLD web conference, namely,
- to be able to invite you to the meetBLD web conference;
- to enable you to register for the meetBLD web conference;
- to be able to provide you with an access link and if required an access code for the meetBLD web conference;
- to exchange further correspondence/communication with you with regard to the meetBLD web conference.
At the beginning and during the meetBLD web conference, the following data are collected:

- for the proper holding of the meetBLD web conference, namely,
- to enable you to register for the meetBLD web conference using the access link and, if required, the access code;
- to enable you to use the meetBLD web conference;
- to enable you to communicate with the organiser and, if applicable, further participants of the meetBLD web conference (depending on extent of use: acoustically, visually, by using the chat function);
- to be able to hold the meetBLD web conference technically;
- to recognise and solve technical problems.
The data processing takes place
- in order to comply with an agreement concluded with you and is insofar necessary pursuant to Art. 6 para. 1 sentence 1 lit. b General Data Protection Regulation ("GDPR") as well as all (if an employment relationship exists) pursuant to Art. 88 para. 1 GDPR in conjunction with s. 26 Federal Data Protection Act (BDSG) in order to implement this agreement (comprising its initiation and handling) as well as in order to perform the resulting mutual obligations;
- for the purposes of our legitimate interests and is necessary pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR; as regards our legitimate interest in the data processing in the scope of the meetBLD web conference, no prevailing interests, fundamental rights and freedoms of you as data subject are opposed, as the data processing is indispensable for maintaining location-independent communication and/or performing services owed.
- on the basis of consent given by you pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR, insofar as you voluntarily provide non-required information during participation in the meetBLD web conference, use non-required functions and/or have consented to the recording and/or storage of data.
2.2 Cookies
The website meeting.bld.de only uses cookies that are necessary for the smooth functionality of the website. Cookies are small text files which are stored on the visitor's data carrier and which exchange certain settings and data with the website meeting.bld.de via the visitor's browser. A cookie usually contains a character string by which websites and servers can be matched to the precise web browser in which the cookie was stored ("Cookie-ID"). This way, the internet browser can be recognised and identified. BLD is enabled to set up the website meeting.bld.de user-friendly by the use of cookies. Thereby, it can for example be prevented that the visitor has to enter certain data repeatedly.
BLD uses the cookies JSESSIONID, _greenlight-2-3_session, cookie_consented, greenlight_name and guest_id, which store data in order to support the flow of information and functionality of the website. These are no user-related data. The cookies are merely exchanged between the browser/computer of the visitor and the website. With the exception of the cookie guest_id, all cookies will be erased after the end of the session. The cookie guest_id will remain for 24 hours.
The intended purpose of the technically required cookies is to enable the use of the website meeting.bld.de, as it is i.a. necessary that the visitor's browser is being recognised for example after a change of websites. BLD does not use these cookies to identify the visitor and does not connect the temporarily stored information with personal visitor data.
The purposes described also constitute the legitimate interest in data processing.
The processing of the data described in number 2.2 is effected on the basis of Art. 6 para. 1 lit. f GDPR.
3. Duration of Processing
Your personal data collected by us in preparation and holding of the meetBLD web conference will be erased after the conference has ended, unless we need them for the further communication with you with regard to the meetBLD web conference, for example to issue a confirmation of participation. Further necessary processing on the basis of our employment relationship, our client or other business relationship or other agreement remains unaffected.
The cookies used during the meetBLD web conference which are exclusively necessary to guarantee functionality will be erased after 24 hours at the latest (see. number 2.2 above).
4. Disclosure of Data to Third Parties
A transmission of your personal data to third parties will only take place if you have given your consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR. In exceptional cases a transfer of your personal data to third parties may become necessary due to our legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, if and insofar as this is not opposed to your interests, fundamental rights and freedoms.
1blu-business GmbH with place of business in Berlin assists us in the processing of your data as processor in terms of s. 28 GDPR. Within the Federal Republic of Germany, this takes place strictly bound by instructions, using an end-to-end encryption and on the basis of a separately concluded processing contract.
5. Your Rights as Data Subject
You have the right:
- pursuant to Art. 7 para 3 GDPR, to withdraw your consent which was once given to us at any time without giving reasons. The consequence of this is that in future we may not continue data processing that was based on this consent.

Die Erhebung dieser Daten erfolgt
- zur ordnungsgemäßen Durchführung des MS Teams Online-Meetings, namentlich
- damit Sie sich mittels des Zugangslinks und ggf. des Raumzugangscodes zum MS Teams Online-Meeting anmelden können;
- damit Sie das MS Teams Online-Meeting nutzen können;
- damit Sie mit dem Organisator des MS Teams Online-Meetings und ggf. weiteren Teilnehmern kommunizieren können (je nach Umfang der Nutzung: akustisch, visuell, durch Nutzung der Chat-Funktion);
- um das MS Teams Online-Meeting technisch durchführen zu können;
- um technische Probleme zu erkennen und zu beheben.
Die Datenverarbeitung erfolgt
- zur Erfüllung einer mit Ihnen geschlossenen Vereinbarung und ist insofern nach Art. 6 Abs. 1 S. 1 lit. b Datenschutzgrundverordnung („DSGVO“) sowie (bei Bestehen eines Beschäftigungsverhältnisses) nach Art. 88 Abs. 1 DSGVO in Verbindung mit § 26 BDSG zur Durchführung dieser Vereinbarung (einschließlich ihrer Anbahnung und Abwicklung) und zur Erfüllung der beiderseitigen Verpflichtungen daraus erforderlich;
- zur Wahrnehmung unserer berechtigten Interessen und ist nach Art. 6 Abs. 1 S. 1 lit. f DSGVO erforderlich; im Hinblick auf unser berechtigtes Interesse an der Datenverarbeitung im Rahmen des MS Teams Online-Meetings stehen überwiegende Interessen, Grundfreiheiten oder Grundrechte von Ihnen als betroffener Person nicht entgegen, da die Datenverarbeitung zur Aufrechterhaltung der ortsunabhängigen Kommunikation und/oder der Erbringung geschuldeter Leistungen notwendig ist;
- auf Grundlage einer von Ihnen erteilten Einwilligung gemäß Art. 6 Abs. 1 S. 1 lit. a DSGVO, soweit Sie im Rahmen der Teilnahme am MS Teams Online-Meeting freiwillig nicht erforderliche Angaben machen, nicht erforderliche Funktionen nutzen oder der Aufnahme und/oder Speicherung von Daten zugestimmt haben.
Es erfolgt keine Aufzeichnung des MS Teams Online-Meetings.
3. Dauer der Verarbeitung
Ihre im Vorfeld und während der Durchführung der MS Teams-Videokonferenz von uns erhobenen personenbezogenen Daten werden von uns nach deren Beendigung gelöscht, es sei denn, wir benötigen diese zur weiteren Kommunikation in Hinblick auf die MS Teams-Videokonferenz, etwa um eine Teilnahmebestätigung auszustellen. Auf den Servern von Microsoft werden die Daten nach Mitteilung von Microsoft spätestens nach 180 Tagen endgültig gelöscht. Davon unberührt bleibt eine aufgrund unseres Beschäftigungsverhältnisses, unserer Mandats- oder sonstigen Geschäftsbeziehung oder anderweitigen Vereinbarung erforderliche Verarbeitung.
4. Weitergabe von Daten an Dritte
Eine Übermittlung Ihrer persönlichen Daten an Dritte findet nur statt, soweit Sie dazu nach Art. 6 Abs. 1 S. 1 lit. a DSGVO Ihre Einwilligung erteilt haben. In Ausnahmefällen kann eine Weitergabe Ihrer Daten auch aufgrund unserer berechtigten Interessen nach Art. 6 Abs. 1 S. 1 lit. f DSGVO erforderlich werden, wenn und sofern nicht Ihre Interessen, Grundfreiheiten oder Grundrechte entgegenstehen. Nicht ausgeschlossen werden kann aber, dass sich US-amerikanische Ermittlungsbehörden auf Grundlage des US-amerikanischen Rechts Daten, die zur Sitzung durch den Anbieter Microsoft gespeichert und noch nicht gelöscht wurden, beschaffen können.
Bei der Verarbeitung Ihrer Daten unterstützt uns die Microsoft Ireland Operations Limited mit Sitz in Dublin als Auftragsverarbeiter im Sinne des Art. 28 DSGVO. Das geschieht streng weisungsgebunden unter Verwendung einer End-zu-End-Verschlüsselung während des Transports und auf Grundlage eines gesondert geschlossenen Auftragsverarbeitungsvertrages. Eine Datenverarbeitung außerhalb der Europäischen Union (EU) erfolgt grundsätzlich nicht, da wir unseren Speicherort auf Rechenzentren in der Europäischen Union beschränkt haben. Wir können aber nicht ausschließen, dass das Routing von Daten über Internetserver erfolgt, die sich außerhalb der EU befinden. Dies kann insbesondere dann der Fall sein, wenn sich Teilnehmende an „Online-Meeting“ in einem Drittland aufhalten.
5. Ihre Betroffenenrechte
Sie haben das Recht:
- gemäß Art. 7 Abs. 3 DSGVO Ihre einmal erteilte Einwilligung jederzeit ohne Angaben von Gründen uns gegenüber zu widerrufen. Dies hat zur Folge, dass wir die Datenverarbeitung, die auf dieser Einwilligung beruhte, für die Zukunft nicht mehr fortführen dürfen;
- gemäß Art. 15 DSGVO Auskunft über Ihre von uns verarbeiteten personenbezogenen Daten und bestimmte weitere Informationen zu verlangen;
- gemäß Art. 16 DSGVO unverzüglich die Berichtigung unrichtiger oder Vervollständigung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen;
- gemäß Art. 17 DSGVO die Löschung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen, soweit nicht die Verarbeitung zur Erfüllung einer rechtlichen Verpflichtung (z.B. auf Grund von Aufbewahrungsfristen), zur Ausübung des Rechts auf freie Meinungsäußerung und Information, aus Gründen des öffentlichen Interesses oder zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist;
- gemäß Art. 18 DSGVO die Einschränkung der Verarbeitung Ihrer personenbezogenen Daten zu verlangen, soweit die Richtigkeit der Daten von Ihnen bestritten wird, die Verarbeitung unrechtmäßig ist, Sie aber deren Löschung ablehnen und wir die Daten nicht mehr benötigen, Sie jedoch diese zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen oder Sie gemäß Art. 21 DSGVO Widerspruch gegen die Verarbeitung eingelegt haben;

2. Processed Data and Purposes of Processing
2.1 Usage Data
Upon opening a BLD website, BLD temporarily stores various general data and information about the system accessing the website ("usage data") on the server, which may possibly allow an identification of the visitor. These usage data contain date and time of the server request, type and version of the browser used, operating system of the accessing system and website from which the BLD website is accessed (so-called referrer), name of the access provider, sub-pages accessed from the BLD website, internet protocol address (IP address), notification of successful retrieval, transmitted data volume and duration of transmission as well as data comparable to any of these data.
The processing of usage data is effected on the basis of Art. 6 para. 1 sentence 1 lit. f of the European General Data Protection Regulation ((EU) 2016/679) - ("GDPR").
BLD needs the usage data to make the BLD websites accessible, to maintain their technical operability and to prevent and, where necessary, prosecute misuse of the BLD websites. In an anonymised form, i. e. without the possibility of identifying the visitor, these usage data finally serve the purpose of optimising the BLD websites as well as statistical purposes.
The purposes described also constitute the legitimate interest in data processing within the meaning of Art. 6 para. 1 sentence 1 lit. f GDPR.
2.2 Cookies
The BLD websites only use cookies in the context of client log-ins that are necessary for the smooth functionality of this feature on the website. Cookies are small text files which are stored on the visitor's data carrier and which exchange certain settings and data with the systems of BLD via the visitor's browser. A cookie usually contains a character string by which websites and servers can be matched to the precise web browser in which the cookie was stored ("Cookie-ID"). This way, the internet browser can be recognised and identified. The use of cookies enables BLD to set up a user-friendly client log-in process on the BLD websites. Thereby, it can be prevented that the visitor has to enter certain data repeatedly.
BLD uses TYPO3 session cookies for this, which store data in order to support the flow of information and functionality of the website. These are no user-related data. The cookie is merely exchanged between the browser/computer of the visitor and the website and is erased after the visitor logs off from the client area. The intended purpose of the technically required cookies is to enable the use of the BLD websites, as it is i.a. necessary that the visitor's browser is being recognised for example after a change of websites.
BLD does not use these cookies to identify the visitor and does not connect the temporarily stored information with personal visitor data. The visitor may prevent the storage of cookies by the respective BLD website at any time by making corresponding settings in the web browser used and may thus object to the storage of cookies permanently. If the visitor deactivates the storage of cookies in the browser used it is not possible to use the client login on the BLD website. The purposes described also constitute the legitimate interest in data processing. The processing of the data described in number 2.2 is effected on the basis of Art. 6 para. 1 lit. f GDPR.
2.3 Data Submitted in the Course of Contacting
BLD enables interested visitors of the BLD websites to contact BLD and for example submit job applications to BLD online. The data submitted to BLD in this context are used by BLD only in order to process the respective request and are not passed on to third parties. When using the contact form, moreover the IP address of the accessing system and the date and time of transmission are stored. Such data are exclusively stored for the purpose of retracing potential misuse. The purposes described also constitute the legitimate interest in data processing. The processing of the data described in number 2.3 is effected on the basis of Art. 6 para. 1 lit. b and lit. f GDPR.
2.4 Newsletter
On the BLD websites there is the possibility to subscribe to a newsletter. Upon subscribing, the interested visitor enters their form of address and title (both optional), first name, last name, e-mail address, company and the topic about which the visitor wishes to receive the newsletter. Such data are exclusively used for the dispatch of the newsletter and are not passed on to third parties. The processing of the data described in number 2.4 is effected on the basis of Art. 6 para. 1 lit. a GDPR.
3. Location of Data Storage
Unless otherwise described in this data protection declaration, the processing of personal data is carried out exclusively in data centres that are located within the scope of the GDPR.
4. Duration of Storage
Personal data will be erased as soon as they are no longer needed for the purposes described in this data protection declaration, unless statutory provisions allow or require a longer period of storage.
Insofar as personal data are stored for receiving the newsletter, these data will be erased as soon as the visitor unsubscribes from the newsletter or withdraws their consent.
5. Visitor Rights
The visitor as well as all other persons concerned by the usage of data by BLD are entitled to obtain information about the personal data stored by BLD.
Moreover, these persons have the following rights concerning the personal data pertaining to them, provided the respective statutory requirements are met:

It is not fully known for any of the providers which data are collected and how these are processed in each individual case.
