The publication "The Professional Negligence Law Review" gives an overview of the national (professional) liability regulations in ten different countries of the world. Thus, it deals with the legal situation in the USA, Argentina, Brazil, England and Wales as well as in further European countries. BLD partners Dr. Martin Alexander, LL.M. and Carsten Hösker, LL.M. report on the legal situation and current developments in the year in review in Germany.
Starting with the general liability provisions of the German Civil Code (BGB), the authors then discuss the statutes of limitation and the various court instances in Germany before going into the special professional liability provisions in German law. In doing so, they refer to the provisions in the medical field, for lawyers, banking and finance professionals, IT professionals, real estate agents, but also for architects, accountants and insurance brokers. At the end of their report, they look at the most important developments and decisions of the past year in this field.
