Despite low interest rates and rising inflation, life insurance products continue to be crucial when building capital and protecting against risk. Innovative products tracking specific indices or funds as well as dynamic hybrid products that incorporate various tools, such as value protection mechanisms or automatic fund shifts, have largely replaced traditional guaranteed investment products. However, there is still an enormous need for advice and clarification in the management of portfolios of traditional guaranteed investment products. We therefore not only provide life insurers with advice on the development and implementation of new product ideas in terms of contract law and regulation; we also support them in the implementation of sustainable sales concepts, in the knowledge that the increasing complexity of products and constantly new regulatory requirements for sales (especially currently in the area of sustainability) pose ever growing challenges for the sale of life insurance products. Improving the management of portfolios is also part of our core competence.
In addition to advising on new business, we also support our clients in particular with the handling of legal proceedings in the area of life insurance. The spectrum of these proceedings is extremely broad, ranging from the numerous redemption cases of recent years, to coverage disputes – often when insolvency and enforcement law overlaps with company pension schemes (bAV) – to cases in which a claimant asserts pre-contractual negligent advice.
The legal proceedings handled by our firm also focus on cease-and-desist letters, association action proceedings or other antitrust disputes that life insurers face. In this field as well, we draw on many years of experience in handling such proceedings and on our broad knowledge of the industry for the benefit of our clients.

One focus of our regulatory advice to life insurers is coping with the ongoing low-interest environment, be it in the application of insurance regulatory mechanisms, the raising of (external) capital or the development of bespoke reinsurance solutions.
